“My Pool’s Above Ground — I Don’t Need a Fence, Right?”

If you have an above-ground pool in Victoria, you might assume that a fence isn’t necessary. After all, it’s off the ground — surely that’s a barrier in itself?


Unfortunately, that’s one of the most common (and risky) misconceptions when it comes to pool safety compliance.



The Law is Clear


In Victoria, all pools and spas capable of holding more than 300mm (30cm) of water are legally required to have a compliant safety barrier — this includes above-ground pools, inflatable pools, and spas.


It doesn’t matter whether your pool is built into the ground, sits on top of it, or is temporarily installed over summer. If it holds enough water to pose a drowning risk, it must be fenced in line with the applicable Australian Standard.



🚫 “But it’s too tall to climb”


Even if your above-ground pool walls are 1.2m or more in height, that alone often isn’t enough. Here’s why:

  • Ladders, boxes, garden furniture, or nearby trees can easily provide access.

  • Children are remarkably creative climbers — and the law doesn’t take chances.


To comply with the Australian Standard AS1926.1-2012 which is the most commonly referenced standard (note: there are differences depending which Standard applies to your pool/spa), your barrier needs to:

  • Be at least 1.2 metres high

  • Have no climbable objects within the non-climbable zones (NCZ)

  • Include a self-closing, self-latching gate

  • Prevent direct access from the home or garage


If your pool uses a ladder or steps, these need to be securely locked or enclosed in a compliant fenced area when the pool is not in use.



🧾 Registered or Not, You’re Still Responsible


By now, most pool owners know they need to register their pool or spa with their local council and obtain a certificate of compliance every four years. But even if you haven’t yet registered, the law still applies. Failing to install a compliant barrier can result in:

  • Fines from council

  • Insurance implications in the event of an incident

  • Serious safety risks to children or pets
