Do Pool Safety Laws Apply to Rural and Acreage Properties in Victoria?


If you live on acreage or a rural property, you might be wondering:

“Do the same pool safety rules apply to me?”


It’s a very common question across regional Victoria — especially in areas around Ballarat, Bendigo, Colac, Camperdown and the Western District.


The short answer?

Yes.

But there are a few important things rural owners should understand.

No.


Whether you’re on:

  • A 600m² block in town in Bendigo

  • 5 acres outside Ballarat

  • Or 40 acres near Colac


If you have a swimming pool or spa capable of holding more than 300mm of water, it must:

✔ Be registered with your local council

✔ Have a compliant safety barrier

✔ Be inspected within required timeframes

✔ Have a valid Form 23 Certificate of Compliance


These requirements come under the regulations set by the Victorian Building Authority (now Building and Plumbing Commission).

Land size does not exempt you.

This is something I hear often.


Some rural property owners assume that because they:

  • Don’t have close neighbours

  • Don’t have children living nearby

  • Have long driveways or gated access

…that fencing rules don’t apply.

Unfortunately, that’s not how the legislation works.


Pool barrier laws are based on risk prevention, not population density.

Accidents most commonly involve:

  • Visiting grandchildren

  • Family gatherings

  • Guests unfamiliar with the property

Distance from neighbours/ roads does not reduce the legal requirement for a compliant barrier.

Are Farm Dams Exempt From Pool Safety Laws?


Farm dams are treated differently.

A dam used for agricultural purposes is not classified as a swimming pool under the regulations.


However, if you install:

  • An above-ground pool

  • An in-ground pool

  • A swim spa

  • A large portable spa

Then standard pool safety rules apply.


If you’re unsure whether your structure is classified as a regulated pool or spa, it’s worth getting clarification before assuming you’re exempt.

Common Pool Compliance Issues on Rural Properties


In regional inspections, I often see:

  • Old pool barriers that don’t meet height or gap requirements

  • Climbable equipment or shrubs near fences

  • Timber fencing that has deteriorated over time

  • Gates that don’t self-close properly due to ground movement


Rural environments can be tougher on fencing due to wind, stock, and general wear and tear.


Even if your pool was compliant years ago, ongoing maintenance matters.

Do Rural Pools Still Need Inspection Every 4 Years?


Yes.


Once registered with your council, your pool or spa must be inspected and certified at the required interval (every four years).


You must lodge a valid compliance certificate with your council by the due date.

This applies whether you’re in the centre of town or on acreage.

If you’re located on a rural property in Ballarat, Bendigo, Colac, Camperdown, Hamilton or surrounding Western Victoria areas, pool compliance laws still apply — regardless of land size. Owning a rural property does not remove your legal obligations when it comes to pool safety.


If your pool or spa:

  • Holds more than 300mm of water

  • Is capable of being used for swimming or bathing

Then it must comply with Victorian safety regulations.


The good news? Most rural properties can achieve compliance without major changes — it’s often small adjustments that make the difference. These minor adjustments can often be made whilst I’m onsite for the inspection.
