Terms and Conditions
By accessing the Country Vic Pool Inspections website, using information provided by Country Vic Pool Inspections (CVPI), making an enquiry, booking an inspection or engaging CVPI, you acknowledge and agree to the following terms to the extent permitted by law.
1. Acceptance of Terms
By booking, requesting or proceeding with an inspection or other service provided by Country Vic Pool Inspections (CVPI), the client agrees to these Terms & Conditions. These terms also apply to information, guidance and content made available by CVPI through its website or other public channels, subject to the Website Information clause below.
2. Scope of Inspection
An inspection is a visual and practical assessment of the pool or spa barrier and associated matters within the agreed scope of the service, having regard to the applicable requirements and circumstances existing at the time of inspection.
An inspection is not a building survey, structural inspection, engineering assessment, electrical inspection, plumbing inspection, pest inspection or general property inspection unless expressly agreed in writing.
3. Point-in-Time Assessment
Pool and spa barrier compliance is assessed as at the date and time of the inspection. A barrier may become non-compliant after inspection due to changes, deterioration, damage, maintenance, weather, landscaping, alterations, gates or latches being adjusted, objects being placed near the barrier, or other circumstances.
A Certificate of Pool and Spa Barrier Compliance, where issued, does not constitute a guarantee that the barrier will remain compliant.
4. Applicable Requirements
The applicable requirements may depend upon matters including the age, registration history, construction and circumstances of the pool or spa and the requirements applicable to that property.
CVPI will assess the barrier against the requirements considered applicable at the time of inspection. CVPI does not guarantee that a council, building surveyor, regulator, purchaser, insurer or other person will reach the same conclusion or interpret a requirement in the same manner.
5. Access and Information
The client must provide safe and reasonable access to all areas necessary for the inspection and provide any relevant information, documents, council correspondence, previous certificates, permits or other information reasonably requested by CVPI.
Where relevant information is unavailable, inaccurate or withheld, this may affect the scope or outcome of the inspection.
6. Safe Access and Unsafe Conditions
CVPI may decline, postpone, limit or terminate an inspection where access or conditions are unsafe or where the inspection cannot reasonably be completed.
This may include, but is not limited to, unsafe structures, aggressive animals, hazardous surfaces, dangerous weather, excessive vegetation, contaminated water, electrical hazards, inaccessible areas or other conditions presenting a risk to people or property.
7. Pets and Animals
The property owner or occupier is responsible for ensuring that all dogs, animals and other pets are safely restrained or removed from areas required for the inspection before CVPI arrives.
CVPI is not responsible for injury, loss, damage, delay or inability to complete an inspection arising from animals that have not been appropriately restrained.
8. Client and Owner Responsibilities
The property owner or responsible person remains responsible for the ongoing safety, maintenance and operation of the pool or spa barrier.
This includes ensuring that gates, doors, latches, locks, windows, screens and other components continue to operate correctly and that the barrier is not compromised by landscaping, furniture, toys, equipment, vehicles, vegetation, structures, climbable objects or other changes.
9. Children and Supervision
An inspection does not replace active supervision of children around swimming pools and spas.
CVPI does not provide supervision or assume responsibility for children, guests, residents or other persons at the property during or after an inspection.
10. Rectification and Repairs
CVPI does not ordinarily undertake construction, installation, repair, alteration, servicing, remediation or other physical rectification work on pool or spa barriers.
Where CVPI identifies a matter requiring rectification, responsibility for obtaining and carrying out that work remains with the property owner or responsible person.
Work performed by another person or contractor is the responsibility of that person or contractor. CVPI does not guarantee or warrant the quality, suitability or compliance of work performed by another person.
11. Reinspection
A reinspection is a separate assessment of the barrier as it exists at the time of the reinspection.
A reinspection does not guarantee that a Certificate of Pool and Spa Barrier Compliance will be issued. The outcome will depend upon the condition of the barrier and the applicable requirements at the time of that assessment.
12. Certificates and Council Requirements
Where CVPI issues a Certificate of Pool and Spa Barrier Compliance or other documentation, it is issued on the basis of the inspection undertaken and information available to CVPI at that time.
The issuing, acceptance, registration or use of a certificate may be subject to requirements or processes of the relevant council or other authority. CVPI cannot guarantee the actions, decisions, processing times or requirements of a council or other authority.
13. No Guarantee or Warranty
Except where expressly required by law, CVPI does not provide a guarantee or warranty that a particular pool or spa barrier will:

remain compliant;
-
obtain approval from a council or other authority;

satisfy the requirements of a future inspection;

remain suitable following alterations or changes; or
-
be accepted by a purchaser, insurer, regulator or other third party.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory right or other liability that cannot legally be excluded or limited.
14. Limitations of Inspection
An inspection is based on conditions reasonably observable and accessible at the time of inspection.
CVPI is not responsible for defects, deterioration, damage, hidden conditions or other matters that were not reasonably observable or accessible during the inspection.
Where an area or component cannot reasonably be inspected, CVPI may identify the limitation in the inspection report or other documentation.
15. Measurements and Testing
Measurements and testing undertaken during an inspection are undertaken using reasonable inspection methods and equipment appropriate to the service.
Minor variations may occur due to equipment, environmental conditions, surfaces, construction tolerances or other circumstances. Where a measurement is material to the assessment, CVPI will use reasonable professional judgement in interpreting the result.
16. Third-Party Information
CVPI may consider information supplied by owners, occupiers, councils, builders, previous inspectors or other third parties.
CVPI is entitled to reasonably rely upon information supplied by others unless there is an apparent reason to question its accuracy.
17. Website and General Information
Information provided on the CVPI website, social media, articles, FAQs, guides, posts or other public material is provided for general educational and informational purposes only.
Such information is not a substitute for a property-specific professional assessment and should not be relied upon as confirmation that a particular pool or spa barrier is compliant.
Requirements can depend upon the individual property, the age and registration history of the pool or spa, applicable legislation and standards, council requirements and other circumstances. Information may also become outdated or require correction.
CVPI does not accept responsibility for decisions made solely in reliance upon general website or public information where the particular property and circumstances have not been professionally assessed.
18. Estimates and General Guidance
Any comments, estimates, preliminary opinions or guidance provided before an inspection are indicative only unless expressly identified as the outcome of a completed professional assessment.
Photographs, videos, measurements or descriptions supplied remotely may not reveal all relevant conditions.
19. Fees and Payment
Inspection and other service fees are payable in accordance with the invoice issued by CVPI.
Unless otherwise agreed, payment is due by the date stated on the invoice.
CVPI may charge reasonable additional fees where additional services, travel, repeat attendance, waiting time or work outside the agreed scope is requested or required.
20. Cancellation and Delays
Where an inspection cannot proceed because of circumstances outside CVPI's reasonable control, including unsafe conditions, lack of access, animals, severe weather or other circumstances, the inspection may be rescheduled.
Where CVPI has attended the property and cannot reasonably complete the agreed inspection due to circumstances for which the client is responsible, an additional attendance fee may apply.
21. Limitation of Liability
To the extent permitted by law, CVPI's liability arising from or in connection with services provided will be limited to the extent permitted under applicable law and will take into account the nature and scope of the services actually provided.
CVPI will not be liable for loss or damage arising from matters outside the agreed scope of the service, matters that were not reasonably observable or accessible, information supplied incorrectly by the client or third parties, changes made after the inspection, or the acts or omissions of other persons.
Nothing in these Terms & Conditions excludes, restricts or modifies liability that cannot legally be excluded, restricted or modified.
22. Indirect or Consequential Loss
To the extent permitted by law, CVPI is not responsible for indirect or consequential loss arising from matters outside the agreed scope of the professional service, including losses arising from delays, changes to property transactions, inability to obtain a certificate, or decisions made by councils, regulators, purchasers, insurers or other third parties.
23. Changes to the Property
The client acknowledges that any alteration, repair, landscaping, construction, removal or addition affecting the pool, spa or barrier after an inspection may affect compliance.
A previous inspection or certificate should not be relied upon as confirmation of compliance following such changes.
24. Applicable Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
25. Statutory Rights
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified under applicable Australian law.
